Who this is for
Hong Kong employers of a foreign domestic helper whose SEC is nearing expiry — renewing with the same helper, ending at two years, or ending early under Clause 10. Short plain order from public LD / ImmD materials. Not an agency. Not legal advice.
What you must diary before expiry
- ImmD renewal window — within 8 weeks before expiry. Same-employer renewal is a fresh ImmD application (new SEC + helper/employer forms), not an auto-roll. Verified — ImmD FDH page; GovHK online renewal.
- Clause 13 home leave — ≥ 7 days between contracts. If you renew, the helper must return to the place of origin for a vacation of not less than seven days (passage paid by you), unless ImmD approves a deferral. That vacation is in addition to statutory annual leave. Verified — LD FDH FAQ Q4; ImmD SEC Clause 13 notes.
- Final pay within 7 days of expiry or termination. Outstanding wages, leave pay where due, SP/LSP if EO tests are met, return passage, and the food & travelling allowance. Prefer bank transfer. Verified — LD FDH FAQ Q11–Q14; Practical Guide.
- If ending: ImmD ID 407E within 7 days. Both parties must notify the Director of Immigration within seven days of the termination date (ID 407E / letter / GovHK). Verified — LD FDH FAQ Q8; www.gov.hk/fdhtermination.
- Return passage + HK$100/day food & travelling allowance. On completion or termination, free return passage to the place of origin plus HK$100 per day for the most direct route. - Never withhold documents. Passport, HKID, bank cards, SEC copy stay with the helper — do not keep them as “security.” Verified — LD Handy Guide §4.10; LD Dos and Don’ts.
