Typhoon, Black Rainstorm & extreme conditions for FDH employers

Live-in foreign domestic helpers work in your home. Agree weather arrangements early, put safety first when Black Rainstorm, Signal 8 or higher, or “extreme conditions” are in force, and do not claw rest days, leave, or wages to “make up” weather hours. Based on Labour Department Code of Practice and Hong Kong Observatory materials. Not legal advice — and not a statutory “typhoon holiday” for FDHs.

Problem

Every wet season employers ask the same WhatsApp questions: Must she still go to the market under Black rain? Does T8 cancel Sunday rest day? Can I deduct hours she could not work? The answers sit in the Labour Department Code of Practice in Times of Adverse Weather and “Extreme Conditions” (May 2026), HKO warning pages, and the FDH employment handbook — not in agency chat. This map is for the employer side of a live-in household.

Steps

  1. Know the two warning systems — they are independent. Tropical cyclone signals (T1 / T3 / T8 and higher) are separate from the Rainstorm Warning System (Amber / Red / Black). Either (or both) can be in force. Hong Kong Observatory is the authority for issuing and cancelling them. Under Black Rainstorm and under T8+, official FDH guidance is to stay indoors / take shelter. Verified — HKO tropical cyclone precautions; HKO Rainstorm Warning System; LD FDH Employment handbook (Black / T8+ stay indoors).
  2. Agree weather work arrangements with the helper in advance. The Labour Department Code of Practice (May 2026) expects employers and employees to agree how work will be handled when adverse weather or “extreme conditions” hit — report for duty, release, and resume. Safety first. For a live-in FDH the workplace is the home: indoor domestic duties may continue if the flat is safe. Stop outdoor or exposed errands (market run, outdoor school escort, rooftop laundry) when Black / T8+ / extreme conditions make travel or outdoor work unsafe. Verified — LD CoP May 2026 (agree arrangements early). Likely — application of indoor-continue / outdoor-stop to live-in FDH (workplace = home; CoP safety-first principles). State this as Likely, not a hard statutory rule.
  3. Pre-No. 8 Special Announcement ≈ T8 expected within about two hours. Use that window to finish outdoor precautions (secure balcony items, bring in laundry, cancel outdoor errands). Do not send the helper out for non-essential outdoor tasks once T8 / Black / extreme conditions make travel unsafe. Verified — HKO / LD CoP on Pre-No. 8 Special Announcement timing.
  4. Do not compel rest-day work because of a typhoon. A rest day remains a rest day. You may not compel work on a rest day except in unforeseen emergency, with the Employment Ordinance substitute / compensation rules. Typhoon or Black rain is not a free pass to cancel Sunday rest. Related: Rest day & holiday map. Verified — EO rest-day rules; LD Practical Guide for FDH (rest days).
  5. Do not claw leave to “make up” weather hours. Do not reduce annual leave, statutory holidays, or rest days to offset hours lost because of T8+, Black Rainstorm, or extreme conditions. Verified — LD CoP Ch.4 / wages & leave section.
  6. Do not deduct wages or attendance bonus for weather absences handled under CoP principles. If you arranged that staff need not report, or absence was beyond control and handled per the Code, do not dock pay or attendance bonuses for that. Wage deductions are tightly restricted under the Employment Ordinance. Verified — LD CoP (wages / attendance); EO deduction limits.
  7. Employees’ Compensation travel cover in the weather window. Injury or death while the employee is travelling by a direct route between home and the place of work, within 4 hours before the start or 4 hours after the end of working hours, when T8 or higher, Red or Black Rainstorm, or extreme conditions are in force, is deemed to arise out of and in the course of employment — the employer is liable under the Employees’ Compensation Ordinance. Verified — LD CoP / ECO note in the CoP.
  8. Keep EC insurance in force — weather days do not pause your duty. Employees’ compensation insurance must already be in place before work starts and stays on through the wet season. Detail: Insurance before day one. Verified — ECO / LD FDH insurance duty.
  9. Emergency plan: 999 and how to reach you. Life-threatening situations → call 999. The helper should know how to reach you (and a backup contact) when signals are up. Decision tree: When to call Labour Dept vs ImmD vs police. Verified — LD FDH handbook emergency tip.
  10. Write a one-page household typhoon plan before the season. Tropical cyclone season in Hong Kong commonly peaks June–October. Before the peak, write a short household plan: who stays indoors, which outdoor duties stop, how you resume after cancellation, food / water / medicine stock, balcony / window checks, and contacts. Verified — LD FDH handbook (season / stay-indoors guidance). Likely — one-page written household plan as good employer practice (not a named statutory form).

FAQ

Is Signal 8 the same as Black Rainstorm?

No. Tropical cyclone Signal 8 (and higher) is part of the cyclone warning system. Black Rainstorm is part of the separate Rainstorm Warning System (Amber / Red / Black). They can be in force at different times, or together. HKO issues both. Verified — HKO.

Does T8 cancel a Sunday rest day?

No. A rest day remains a rest day. You cannot compel work on a rest day except in an unforeseen emergency, and then the Employment Ordinance substitute / compensation rules apply. Typhoon is not a free pass to cancel rest. Verified — EO / LD Practical Guide rest days.

Must the helper keep cleaning during Black rain?

Indoor domestic work in a safe flat may continue — the workplace for a live-in FDH is the home. Do not send the helper outdoors for errands or exposed tasks when Black / T8+ / extreme conditions make travel or outdoor work unsafe. Safety first. Verified — LD CoP (agree arrangements; safety). Likely — indoor-continue / outdoor-stop application to live-in FDH.

Is there a statutory “typhoon holiday” or typhoon allowance for FDHs?

Do not invent a statutory typhoon holiday or a fixed dollar typhoon allowance from this checklist. Follow the CoP on arrangements, leave, and wages; check any allowance you offer against the signed SEC and EO. Re-check LD / HKO before you act. Not legal advice.

Is this legal advice?

No. Re-check the current Labour Department Code of Practice PDF, HKO warning pages, the FDH employment handbook, and your signed Standard Employment Contract before you act.
